The DD Act Reauthorization and H.R. 797: Overview of VOR's concerns and related solutions

VOR members visited the offices of every Member of Congress during the week of June 12, 2000. They shared information related to H.R. 797 (and its companion, S. 88), which aims to ensure certain managed care safeguards for people with disabilities, and information related to the Developmental Disabilities Assistance and Bill of Rights Act (DD Act) reauthorization.

The DD Act programs are funded through the U.S. Department of Health and Human Services. The Senate's version of the reauthorization (S. 1809) passed in the Fall of 1999. No reauthorization bill has yet been introduced in the House.

VOR's objectives in sharing this information included -

(A) Support DD Act reauthorization by the 106th Congress, with a few changes to protect people with severe and profound mental retardation (see 1,2, and 3 below).

(B) A Commerce Committee hearing on the reauthorization of DD Act. Letters to Chairman of the Commerce Committee, Thomas Bliley (R-VA), from Congressional offices in support of a hearing on this issue are needed.

(C) Passage of H.R. 797 and S. 88 by the 106th Congress either as stand alone measures, or in conjunction with the DD Act Reauthorization. These common-sense, no cost (per CBO) measures help ensure that all people with disabilities enjoy access to specialized health care in a managed care construct.

VOR is requesting amendments to the DD Act that -

(A) Expressly support choice in residential options, including ICF/MR and institutional settings.

(B) Limit class action litigation to situations in which the residents of the facility, or their family members/guardians as appropriate, agree that litigation is required to redress systemic abuse and neglect.

(C) Incorporate the provisions of H.R. 797 in the reauthorization of the DD Act.
