The Deficit Reduction Act of 2005:

Technical changes are needed

to ensure Congressional Intent

 

 

VOR urges every Member of Congress to swiftly approve a technical correction to address a serious apparent drafting error contained in the Deficit Reduction Act of 2005 (DRA).

 

The DRA added a new section (1916A) to the Social Security Act, which sets out state options for cost-sharing in Medicaid.  Section 1916A could be interpreted to allow unlimited cost-sharing and premiums for beneficiaries with incomes below the poverty line while limiting cost-sharing for beneficiaries with incomes above poverty.

 

Apparently, an intended provision that would have left in place prior cost-sharing amounts for low-income beneficiaries was dropped.

 

People with mental retardation receiving community-based residential supports, assisted living and group home settings, are among those vulnerable citizens who will be seriously impacted by this language.

 

VOR feels certain that Congress did not intend this result.

 

We look forward to working with you to correct the problem with Section 1916A and to assure that states are able to implement DRA provisions in accord with Congress’ intent.
